Welcome to Clairemont Water Store. These Terms of Service (“Terms”) govern your access to and use of the website at clairemontwater.store (the “Site”), our online store, and any related services we provide (collectively, the “Services”). The Services are operated by Clairemont Water Store, located at 3077 Clairemont Dr #105, San Diego, CA 92117. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make purchases or create an account on the Services. By using the Services, you represent that you meet this requirement and that the information you provide is accurate.

Accounts and Sign-In

Certain features may require you to sign in. We may offer sign-in through third-party providers (such as Google) in addition to email-based sign-in. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized access.

Orders, Pricing, and Payments

Product descriptions, availability, and pricing are subject to change without notice. We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, pricing errors, or product unavailability. Applicable sales tax (currently 7.75% in San Diego, CA) will be added at checkout. Payments are processed by third-party providers (such as Square) and are subject to their terms.

Pickup, Delivery, and Returns

Orders may be available for in-store pickup or other fulfillment options as offered at checkout. Because of the nature of our products (bottled water, ice, and related goods), all sales are generally final. If a product arrives damaged or incorrect, contact us within 7 days of purchase and we will work with you to resolve the issue.

Acceptable Use

You agree not to use the Services to:

  • Violate any law, regulation, or third-party right
  • Submit false, misleading, or fraudulent information
  • Interfere with or disrupt the Services, our servers, or networks
  • Attempt to gain unauthorized access to any portion of the Services or related systems
  • Use automated tools to scrape, copy, or harvest data from the Site
  • Upload or transmit viruses, malicious code, or harmful content
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity

Intellectual Property

All content on the Services — including text, graphics, logos, product images, and software — is owned by Clairemont Water Store or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission, except as expressly permitted by these Terms.

User Submissions

If you submit feedback, reviews, testimonials, or other content to us, you grant Clairemont Water Store a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with the Services and our marketing. You represent that you have the right to grant this license and that your submission does not violate any third-party rights.

To the fullest extent permitted by law, Clairemont Water Store and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Services. Our total liability for any claim related to the Services shall not exceed the amount you paid us in the 30 days preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Clairemont Water Store and its owners, employees, and contractors from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your misuse of the Services, or your violation of any law or third-party right.
